TK ANYI AVIT & ORS – Appellant
Versus
PUSAKA KTS FORESTS PLANTATION SDN BHD & ORS – Respondent
[Suit No: MYY-21NCvC-8/9-2015]
The action for Native Customary Rights is not statute-barred under the Limitation Ordinance or Public Authorities Protection Act due to a continuing injury.
Headnote:This judgment concerns the claims for Native Customary Rights (NCR) over land, exploring the applicability of the Limitation Ordinance Sarawak and the Public Authorities Protection Act 1948. The court found that the plaintiffs' action is not statute-barred due to a continuing injury. Primary issues included whether the plaintiffs' cause of action was barred by the specified laws, with the court concluding that the limitations did not apply since the action involved ongoing injury to rights. The court allowed the suit to proceed for trial on remaining issues. The plaintiffs are entitled to pursue their claims.
