RANGIT SINGH GURNAM SING – Appellant
Versus
TEAM DURABLE SDN BHD – Respondent
[Companies Winding-Up Petition No: 28NCC-72-12/2014]
The court may order winding up if a company is unable to pay its debts, proven through statutory notice and non-payment.
Headnote:Under s 218(1)(e) Companies Act 1965, a winding-up petition may be filed if a company is unable to pay its debts. The petitioner successfully established that the respondent, Team Durable Sdn Bhd, owed RM35,543.75 following a judgment. The court found that the statutory notice was properly served and the respondent neglected to settle the debt. Issues included the validity of service and the disputed nature of the debt. The court held the petitioner had a statutory right to file the winding-up petition despite the respondent's claim of a bona fide dispute. The court found in favor of the petitioner, leading to the winding up of the respondent.
