Courts exercise discretion in granting extensions of time based on delay reasons, lack of intention to ignore procedural rules, and the applicant's conduct. Significant delays without valid reasons lead to dismissal of appeals.

Headnote:(A) Legal Profession Act 176 (Act 166) - Section 103E - Disciplinary proceedings - Appeal against cancellation of name from the roll of advocates - Appeal filed 2 years later than the specified period - Court considers factors for extension of time to appeal, including delay and reasonableness. (Paras 3, 5, 6, 10, 11)

(B) Discretionary power - Court retains discretion to grant or refuse extension of time based on delay and conduct of the applicant - Prior knowledge of disciplinary proceedings relevant to the case. (Paras 7, 8, 10, 11)

Facts of the case:
The appellant's name was cancelled by the Disciplinary Board on 09 September 2011, and the appeal was not filed until 10 December 2013, over 2 years later without reasonable explanation.

Findings of Court:
The application for extension of time was dismissed due to significant delay and lack of valid grounds.

Issues: Whether the delay in filing the appeal was justified and if the court has the discretion to grant an extension.

Ratio Decidendi: The court ruled that available grounds for delay were not sufficient to justify an extension as required by the rules; thus, the appeal was dismissed.

Result: Application for extension of time is dismissed.

[1] Dalam Kandungan 1 perayu merayu terhadap antara lainnya keseluruhan keputusan Lembaga Tatatertib Peguam-Peguam (DB) yang dibuat pada 09 September 2011 yang memutuskan supaya nama perayu dibatalkan dari daftarai peguambela dan peguamcara Mahkamah Tinggi Malaya.

[2] Namun rayuan ini hanya difailkan pada 10 Disember 2013, lebih 2 tahun daripada keputusan DB itu.

[3] Perayu telah memfailkan Kandungan 22 iaitu untuk perintah melanjutkan masa untuk menyampaikan dan memfailkan Notis Rayuan terhadap keputusan yang diberikan oleh DB itu pada 31 Mac 2014.

Kandungan 22

[4] Seksyen 103E Legal Profession Act 176 (Act 166) antara lainnya memperuntukkan seperti yang berikut:

"103(E) Appeal from the decision of the Disciplinary Board

(1) Any party aggrieved by any decision or order made by a Disciplinary Board shall have the right to appeal to the High Court within one month of notification of the decision or order complained against."

[5] Di dalam kes Nadarajan Verayan v. Hong Tuan Teck (No.2), 2007 MarsdenLR 1081 di mana Yang Arif Abdul Malik Ishak J (pada ketika itu) memutuskan bahawa:-

"Notwithstanding the fact that Lily Rossel Sebastian (supra) held that the RHC was applicable by virtue ofr. 11 of the Legal Profession (Disciplinary Proceedings) (Appeal) Rules 1994, yet certain factors have to be taken into account in deciding whether to extend time because that power is entirely and purely discretionary in nature. And those factors may be stated in the words of Faiza Tamby Chik J in Khan v. Lee Kok Hooi , 2000 MarsdenLR 1743 , 459-460 as follows:

......In exercising its discretion under O 3 r 5(1) of the RHC, the Court should take into account certain factors, such as:

(a) the delay in making the application;

(b) whether or not there are cogent reasons for the litigant not to have made the application within the prescribed time;

(c) the likelihood and degree of prejudice, as well as the injustice to the opposite party should the Court exercise its discretion."

[6] Berdasarkan faktor-faktor tersebut, sekiranya dikaji permohonan perlanjutan masa perayu, perayu telah terlewat selama 2 tahun 3 bulan dari tarikh perintah 09 September 2011. Perayu juga tidak memohon perlanjutan masa dalam Saman Pemulanya tetapi hanya memfailkan permohonan untuk perlanjutan masa selepas pelbagai permohonan termasuk permohonan untuk 'merecuse' diri saya dan permohonan untuk mencegah Tetuan George Varughese dari bertindak mewakili responden. Permohonan tersebut hanya difailkan pada 31 Mac 2014 walaupun rayuan perayu telah difailkan seawal Disember 2013. Malahan, untuk permohonan di Kandungan 22 ini sendiri, perayu telah pertama kali menyatakan hasratnya untuk memfailkan permohonan ini pada 18 Mac 2014. Mahkamah telah memberi peluang untuk beliau memfailkannya pada atau sebelum 27 Mac 2014. Namun begitu, pada 27 Mac 2014, perayu telah meminta tempoh lagi untuk memfailkan Kandungan 22 ini. Hal ini jelas menunjukkan bahawa tindakan perayu adalah pemikiran semula selepas responden mengusulkan bantahan berkenaan kelewatan perayu dalam memfailkan rayuan ini. Selain itu, pemfailan rayuan dan permohonan ini jelas "co-incident" dengan pemfailan tindakan kebankrapan terhadap perayu yang mana mengikut Kandungan 26, Afidavit Jawapan Responden, satu Petisyen Kebankrapan telahpun difailkan terhadapnya pada 17 Mei 2013. Perayu pada pandangan saya cuba menggunakan prosiding di sini bagi melengah-lengahkan prosiding di Mahkamah kebankrapan.

[7] Asas bagi satu permohonan perlanjutan masa adalah alasan-alasan yang munasabah mengapa kelewatan itu terjadi. Mahkamah Rayuan dalam kes Thiruchelvasegaram Manickavasegar v. Mahadevi Nadchatiram , [1998] 4 MLJ 297 , telah memutuskan antara lainnya seperti yang berikut:
