Introduction
[1] Enclosure 143 is the Plaintiffs application under O 14A Rules of Court 2012 [ ROC ] for an order that final judgment be entered against the Second Defendant for:-
(i) special damages in the sum of RM4,363,841.00;
(ii) general damages, interest and cost as pleaded in the writ summons and statement of claim; and
(iii) cost of the application.
[2] After hearing submissions and considering all the cause papers this Court dismissed the application. The grounds for the decision are as follows.
