Introduction

[1] There are two charges for trafficking in dangerous drugs under s 39B(1)(a) of the Dangerous Drugs Act 1952 . In Criminal Trial No WA-45A-17 05/2019 ("First Case"), the charge is proffered against 5 accused persons and in Criminal Trial No WA-45A-18-05/2019 ("Second Case"), the charge is proffered against 4 accused persons. Except for the First Case, the accused in both cases are the same.

The Charge

"Bahawa kamu bersama-sama pada 14 January 2019 jam lebih kurang 7:05 petang di kawasan tempat letak kereta Central Park, Jalan Thamby Abdullah Off Jalan Tun Sambanthan, dalam daerah Brickfields, Wilayah Persekutuan Kuala Lumpur, dengan mencapai niat bersama telah mengedar dadah berbahaya, iaitu dadah jenis Methamphetamine berat bersih 356.4 gram. Oleh itu, kamu telah melakukan kesalahan di bawah s 39B(1)(a) Akta Dadah Berbahaya 1952 dan boleh dihukum di bawah s 39B(2) Akta yang sama."
