Pendahuluan

[1] Aziz Latip bin Hasannar ("Pemohon") telah memfailkan permohonan bagi mendapatkan suatu perintah pelepasan dengan jaminan (bail) sementara menunggu penyelesaian kes iaitu Nombor Kes BA-45JT-7-09/2022 dalam Mahkamah ini.

[2] Pada 26 Januari 2023, setelah membaca dan meneliti semua afidavit yang telah difailkan dalam tindakan ini serta mengambil kira penghujahan oleh pihak-pihak, Mahkamah ini mendapati bahawa permohonan ini tidak mempunyai merit. Oleh yang demikian, Mahkamah ini telah menolak permohonan tersebut.

[3] Terkilan dengan keputusan Mahkamah ini, pihak Pemohon telah memfailkan notis rayuan bertarikh 27 Januari 2023 ke Mahkamah Rayuan Malaysia menurut kaedah 58(1) Kaedah-Kaedah Mahkamah Rayuan 1994.
