JUDGMENT
Introduction
[1] After a full trial conducted over five days, the plaintiffs' claim grounded on trespass, nuisance, and negligence was dismissed on inter alia the ground that none of them proved that they had legal or possessory rights over the lands alleged to have been encroached and damaged Aggrieved, the plaintiffs appealed and these are the grounds of judgment.
Summary Of Background Facts
[2] The first and second plaintiffs are individuals with a common address for service at No 51-2 Jalan Radin Anum 1, Bandar Baru Seri Petaling, 57000 Kuala Lumpur. They pleaded that they are the joint owners of the propetty known as Lot 3709, Mukim Gali, Daerah Raub, Pahang Darul Makmur ("Lot 3709"). Their assertion of them being joint owners of Lot 3709 was not admitted by the both the defendants.
[3] The third plaintiff is a private limited company incorporated in Malaysia with its registered office at Suite D23, Tkt 2, Plaza Pekeliling, Jalan Tun Razak 50400 Kuala Lumpur, Wilayah Persekutuan. It pleaded that it is the owner of Lot 3710, Mukim Gali, Daerah Raub, Pahang Darul Makmur ("Lot 3710"). Its assertion that it is the owner of Lot 3710 was not admitted by both the
