HIGH COURT MALAYA KUALA LUMPUR
LIAN MENG WAH – Appellant
Versus
UMA PARVATHY THOTHATHRI – Respondent
[Suit No: S-22-862-2005]

A plaintiff must prove ownership and legal standing to sue, which includes establishing compliance with regulatory requirements for land transactions.

Headnote:(A) Tort - Negligence - Duty of care - Plaintiff's former solicitor's alleged mishandling of issue document of title resulting in financial losses - Defendant denied negligence, asserting all reasonable measures taken - Court found no breach of duty and that plaintiff's own conduct contributed to losses. (Paras 8, 9, 21, 26)

(B) Legal capacity - Locus standi - Court found plaintiff lacked legal capacity to sue regarding land held in wife's name - No ownership established to enforce sale agreements due to lack of consent from state authority - Claim dismissed. (Paras 9, 31, 32)

(C) Plaintiff's evidence - Insufficient to prove alleged losses arising from transactions - Claim based on uncorroborated testimony and inconsistent facts - Plaintiff's claim dismissed with costs. (Paras 33, 34, 36)

Facts of the case:
Plaintiff claimed against former solicitor for negligence in handling an issue document of title, resulting in losses from an aborted sale of land. Defendant contended no negligence occurred and that plaintiff's own actions contributed to the situation.

Findings of Court:
Court satisfied that plaintiff failed to prove negligence; thus, the claim and the defendant's counterclaim dismissed with costs.

Issues: Whether plaintiff had locus standi, whether defendant owed duty of care, whether negligence occurred, legality of transactions, and proof of losses.

Ratio Decidendi: Court ruled that the plaintiff did not establish ownership or capacity to enforce the sale, and any negligence attributed to the defendant was mitigated by plaintiff's unreasonable conduct.

Result: Plaintiff's claim dismissed with costs and defendant's counterclaim also dismissed.

Table of Content
1. plaintiff's claim based on lost opportunities. (Para 4)

4. plaintiff's Failure to Prove Losses

[33] Based on the foregoing, the court finds that the plaintiff has failed to prove plaintiff's alleged loss of profit amounting to RM415,135.00 from the purported sale of land to Gunasekaran. Other than plaintiff's own uncorroborated testimony of the purported sale, there is no evidence before this court to support plaintiff's claim of alleged sale and alleged loss of profit from the aborted sale of the plaintiff's land. The plaintiff's testimony in court is generally mere bare assertion and appears to be inconsistent with the contemporaneous documents before the court and, in some parts contradictory with his own testimony. The court finds the plaintiff's narration of events unreliable, and concludes that the plaintiff is the maker of his own misfortune.
