Brief Facts

Plaintiff is a retired school teacher and is currently a private tutor. Defendant is the sister-in-law of the Plaintiff having been married to the late brother of the Plaintiff, Bhagwan Singh a/l Sohan Singh. Plaintiff alleged that the Defendant had prior to or on or about 21.2.2001 falsely and maliciously stated and/or spoke to several 3rd parties including one Harbhajan Kaur, an advocate and solicitor practising in the legal firm called Mazwan Pathma & Co. of Kuala Lumpur of the Plaintiff's conduct in the following words "Harcharan Singh s/o Sohan Singh (the plaintiff) had soon after the death of my husband Bhagwan Singh a/l Sohan Singh (the deceased) removed from the deceased home at No. 59, Jalan Bunga Saroja, Ipoh and No. 513, Hill Railway Road, Ayer Itam, Penang all the deceased personal effects including the contents of his safes" which are slanderous. In addition, Defendant's solicitors Messrs. Mazwan Pathma & Co. vide their letter dated 21.2.2001 (P3) addressed to the Plaintiff's previous solicitors Messrs. Mahinder Singh Dulku & Co. of Penang had published the following:
