2022 MarsdenLR 3031
COURT OF APPEAL PUTRAJAYA
ZULZAMRI ZULKIFLI – Appellant
Versus
PP & OTHER APPEALS – Respondent
[Criminal Appeal Nos: W-05(M)-616-12/2019 W-05(M)-617-12/2019 & W-05(M)-618-12/2019]
Possession and traffiсking can be established through circumstantial evidence, affirming common intention between co-accused when drugs are found in shared premises.
Headnote:(A) Dangerous Drugs Act 1952 – Section 39B(1)(a) and Sections 12(2), 12(3) – Charges for drug trafficking and possession – 1st Appellant and 2nd Appellant convicted of multiple charges including trafficking substances exceeding statutory limits – The learned High Court Judge found sufficient evidence of possession and common intention between the Appellants, based on circumstantial evidence including exclusive access to the premises where drugs were found. (Paras 2, 3, 23, 59)
(B) Common Intention – Section 34 of the Penal Code – The rule serves as a basis for determining joint liability in criminal offences. The court found that mutual intent was established through shared residence and knowledge of the drugs discovered. (Paras 27, 28, 32)
(C) Sufficiency of Evidence – The prosecution's evidence was deemed credible and corroborated, with no reasonable doubt raised by the Appellants against the presumption of trafficking. (Paras 36, 58)
Facts of the case: The Appellants were charged related to the possession of substantial quantities of cannabis, methamphetamine, and other controlled substances, seized during a police raid of a shared apartment. (Paras 6-22)
Findings of Court: The High Court affirmed that both Appellants had exclusive control and knowledge of the drugs found and their defenses did not raise reasonable doubt. (Paras 23, 59)
Issues: The case addressed whether the Appellants were guilty of possession and trafficking based on circumstantial evidence and the applicability of statutory presumptions. (Paras 24, 27)
Ratio Decidendi: The court emphasized that possession and common intention can be established through circumstantial evidence, even in the absence of direct evidence linking the Appellants to the act of trafficking. The court upheld the presumption of trafficking due to the quantities of drugs involved. (Paras 29, 59)
Result: Appeals dismissed; convictions and sentences affirmed.
