SESSION COURT SHAH ALAM
NGU KOH KIET – Appellant
Versus
KOPERASI PEMBANGUNAN PENDIDIKAN BHD & ANOR (ENCL 13) – Respondent
[Civil Suit No: BA-A52-98-09/2023]

Petitioner Advocates:Nishanthinee Palanimalai ,Respondent Advocate: Kalyansundaram Rajagopal

Disputes regarding the management of co-operative societies must be referred to the Commission as per the Co-operative Societies Act 1993, and claims filed in civil court without such referral constitute an abuse of process.

Headnote:(A) Co-operative Societies Act 1993 - Section 82 - Jurisdiction of the Court - Plaintiff, a member of a co-operative society, filed a claim against the First and Second Defendants regarding a fund agreement. The Court found that disputes concerning the management of a co-operative society must be referred to the Commission for resolution, thus dismissing the Plaintiff's claim as an abuse of process. (Paras 100, 101)

(B) Declaratory Relief - The Court ruled that the Plaintiff's request for a declaratory relief was unnecessary and infructuous since the dispute should have been handled by the Commission. (Paras 96, 100)

Facts of the case:
The Plaintiff entered into a fund agreement with the First Defendant, a co-operative society, and sought recovery of contributions after a failure to receive returns. (Paras 7, 10)

Findings of Court:
The Plaintiff's claim was dismissed, and it was ruled that the proper forum for resolving such disputes is the Commission under the Co-operative Societies Act. (Paras 100, 101)

Issues: The main issue was whether the Court had jurisdiction to hear the case or if it should be referred to the Commission as stipulated by the Co-operative Societies Act. (Paras 54, 100)

Ratio Decidendi: The Court emphasized that disputes regarding the management of co-operative societies must be referred to the Commission, reinforcing the principle that the statutory framework provides a specific remedy and forum. (Paras 100, 101)

Result: Application allowed with costs.

a) Tan Poh Yee v. Tan Boon Thien & Other Appeals, :

[17] ... The respondent was a stranger to the purported 2004 Agreement and as a matter of law, could not take advantage of its provisions notwithstanding that some provisions thereof were intended to benefit him.
