Reference
[1] This is a reference made by the Director General of Industrial Relations Malaysia under subsection 20(3) of the Industrial Relations Act 1967 dated 4 April 2023 arising out of the dismissal of Nadhirah binti Othman (hereinafter referred to as "the Claimant") by True Pristine Sdn Bhd (hereinafter referred to as "the Company") on 26 August 2022.
Factual Matrix
[2] The Claimant commenced her employment with the Company as Procurement and Contract Executive for a one-year period, starting from 7 December 2015 to 6 December 2016, based on the Appointment Letter dated 5 November 2015 ("Appointment Letter") (Please refer to CLB-1 pp 3-7). On 24 November 2016, the Claimant received an Extension Letter from the Company informing that her employment as 'Procurement and Contract 6 Executive' was extended from 7 December 2016 to 6 December 2017 (Please refer to CLB-1 p 8).
[3] Upon the expiry the of the Claimant's fixed term contract of service, the Company promoted her as Procurement and Contract Assistant Manager effective 1 November 2019. Thereafter, the Claimant continued working with the Company without interruption until her employment
