[1] This is a reference by the Honourable Ministry of Human Resources dated 6 January 2020 made under s 20(3) of the Industrial Relations Act 1967 received by the Industrial Court on 24 February 2020 arising out of the dismissal of Abdul Rasyid Richard Bin Abdullah ("the Claimant") by The International School of Penang (Uplands) ("the School") on 27 September 2019.
Factual Background
[2] Initially, this matter commenced before the previous Learned Chairman of Court 9 who heard the evidence of the Company's first witness before he was transferred to another government agency. Upon my transfer to the Industrial Court of Penang to Court 18, the matter was then heard and continued before me and I had the opportunity to hear the rest of the matter until its completion before my retransfer to Industrial Court Kuala Lumpur effective 1 November 2022.
