Petitioner Advocates:Jane Tan Yang Qian,Angeline Tay ,Respondent Advocate: Kee Tong Kiak,Choong Jun Hong

The dismissal of an employee for unprofessional conduct and insubordination is justified when the employer establishes just cause through credible evidence.

Headnote:(A) Industrial Relations Act 1967 - Section 20(3) - Dismissal of employee - The court evaluated the circumstances of the claimant's dismissal from the company, which was based on multiple instances of unprofessional conduct and insubordination, including failure to comply with management instructions and use of vulgar language towards a superior. (Paras 1, 17, 101)

(B) Burden of Proof - The employer must provide convincing evidence that the employee committed the alleged misconduct warranting dismissal, with the burden resting on the employer to establish just cause. (Paras 16, 20)

(C) Standard of Proof - The standard in dismissal cases is the balance of probabilities, not beyond reasonable doubt. (Paras 21)

Facts of the case:
The claimant was employed as a Senior Manager and was dismissed following several warnings regarding her performance and conduct, including a vulgar text message to the Group Managing Director. (Paras 4, 8, 101)

Findings of Court:
The court found that the company established just cause for dismissal based on the claimant's repeated unprofessional behavior and failure to adhere to management's expectations. (Paras 101, 104)

Issues: The court addressed whether the claimant's misconduct justified her dismissal and whether the company followed proper procedures. (Paras 17, 101)

Ratio Decidendi: The court held that the claimant's actions, particularly the use of vulgar language and failure to maintain professionalism, constituted just cause for termination, affirming the employer's right to dismiss based on established misconduct. (Paras 101, 104)

Result: Claimant's claim dismissed.
