2010 MarsdenLR 314
HIGH COURT MALAYA KUALA LUMPUR
SEMANTAN ESTATES (1952) SDN BHD – Appellant
Versus
KERAJAAN MALAYSIA – Respondent
[Civil Suit No: S7-21-213-2003]
A land acquisition is invalid if statutory procedures are not followed, and acceptance of compensation under protest does not negate claims against wrongful possession.
Headnote:(A) Land Acquisition Enactment - Sections 4(i), 6(i), 8, 9(ii), 11(i), 22(i), and 22(iv) - Declaration of beneficial interest - Plaintiff claims unlawful possession of land and seeks mesne profits due to wrongful acquisition - The court ruled that prior procedures for acquisition were not followed, thus rendering the acquisition invalid. The defendant's failure to comply with the statutory requirements resulted in wrongful possession. (Paras 1, 14, 19, 21, 26, 28)
(B) Estoppel and Res Judicata - The court reinforced that previous judicial findings preclude re-litigation of issues established in prior judgments. The doctrine of issue estoppel and res judicata apply to the findings in Semantan No. 1, confirming that the absence of valid statutory procedures invalidates subsequent claims. (Paras 24, 26, 27)
Facts of the case:
The plaintiff sought to assert its beneficial interest in land wrongfully taken by the defendant, referencing historical acquisition notifications and compensation disputes spanning several decades. (Paras 1-11)
Findings of Court:
The defendant's possession of the land was deemed unlawful as statutory acquisition processes were not satisfactorily followed, resulting in the confirmation of the plaintiff's claims. (Paras 20, 28)
Issues: Whether the plaintiff's acceptance of compensation nullified their claim against the defendant and the validity of past awards. (Paras 18, 24, 27)
Ratio Decidendi: The court found that the lack of compliance with statutory acquisition requirements invalidated the defendant's claim of lawful possession, emphasizing the significance of proper procedure in land acquisition. The court shall not permit a party to go back on procedural irregularities. (Paras 21, 22, 23, 26)
Result: Plaintiff's claim allowed.
