Heliliah Mohd Yusof FCJ:

[1] The appellant has been convicted under s 302 of the Penal Code . He was originally jointly tried with one Poopalasingam a/l Sappani (SD2), his brother whereby the charge preferred against them reads as follows:

"Bahawa kamu dengan niat bersama-sama pada 21 Mei 2003 jam lebih kurang 11.30 malam hingga 22 Mei 2003 jam lebih kurang 7.00 pagi bertempat di hadapan pintu pagar Ladang Gagoss Sdn B
