This is a reference made under section 20(3) of the Industrial Relations Act 1967 arising out of the dismissal of PUAN NORASHIKIN BINTI ISNIN ("the Claimant") by AKADEMI IMA MENTAL ARITMETIK ("the Company").

AWARD

(In respect of Application by Claimant for Joinder)

The Claimant filed an application dated 10 May 2010 ("the Application") for the following orders:

(a) that I.M.A. Enterprise Sdn. Bhd. is joined as a party to this proceeding to make the Claimant's adjudication effective and enforceable and that the merits of the case can be heard.

(b) that Form L pursuant to Rule 12 of the Industrial Rules 1967 is issued to I.M.A. Enterprise Sdn. Bhd.

(c) any such further or other relief as this Honourable Court deems fit.

The Application is supported by the Claimant's Affidavit In Support affirmed on 7 May 2010.

I.M.A. Enterprise objected to the Application by filing the Affidavit In Reply of Chong Tai Kaw, the Director of I.M.A. Enterprise, affirmed on 24 May 2010.

The Claimant's Contention

The Claimant in her affidavit in support contends as follows;

1) she did a search at the Companies Commission of Malaysia on 14 F
