[1] This is a reference by the Director General of Industrial Relations of Malaysia dated 14 August 2023 pursuant to s 20(3) of the Industrial Relations Act 1967 which was received by the Industrial Court of Malaysia on 21 August 2023 arising out of the alleged unlawful dismissal of CHONG POH LUM (hereinafter referred to as "the Claimant") by PASTEL GLOVE SDN. BHD. (hereinafter referred to as "the Company") on 7 November 2022.
Factual Backgrounds
[2] The Claimant commenced employment with the Company as Assistant Maintenance Manager with three (3) months probationary period with a basic salary of RM7,000.00 per month via WhatsApp message that was unsigned by Lau Siau Woei (Terry). There was no formal agreement issued to the Claimant when he commenced employment on 7 February 2022.
[3] Although the Claimant had in numerous occasions keep on reminding verbally over the months of employment that the Company has failed to issue him with the formal copy of the employment agreement.
