[1] This is a reference made by the Director General of Industrial Relations dated 4 January 2022 pursuant to s 20(3) of the Industrial Relations Act 1967 arising out of the alleged dismissal of Rajivalosana Rajindra Kumar (hereinafter referred to as "the Claimant") by Syarikat V K Kalyanasundram Sdn Bhd (hereinafter referred to as "the Company") on 2 April 2021.

The Company's Application

[2] This is an Application made by the Company pursuant to s 29(g) of the Industrial Relations Act 1967 dated 4 July 2022 for the Company be at liberty to consolidate this action with the following cases:

(a) Perak Industrial Court Case No 10/4-101/22 (Barani Kumar Balasubramaniam v. Syarikat V K Kalyanasundram Sdn Bhd), and

(b) Perak Industrial Court Case No 10/4-102/22 (Vijay Anand Harivasagan v. Syarikat V. K Kalysanasundram Sdn Bhd).

[3] The grounds of this Application are as set out in the Affidavit in Support affirmed by Kalyana Ganesh Krishnamoorthy for the Company dated 24 June 2022 which states, inter alia, as follows:
