Introduction

[1] This is an appeal against the decision of this court in allowing an application (Encl 15) by Chin Oi Khiun ("RW/respondent") with no order as to costs for the discovery of documents, pursuant to O 24 and/or O 92 r 4 of the Rules of court 2012 (" ROC 2012") ("discovery application").

[2] The hearing was heard on 11 May 2023 and the decision was delivered on 20 June 2023 and the petitioner ("PH/appellant") was not satisfied and appealed to the court of Appeal for the decision. The parties are referred to as they were in the High court.

The Application

[3] In this application ("NOA"), the RW applies for the following order:

(1) The petitioner shall within seven days from the date of this order, provide a disclosure of documents in accordance with O 24 r 3 of the Rules of court 2012 and/or O 92 r 4 of the Rules of court 2012 by making and delivering to the respondent a list of the documents relevant to the matters at issue in this action, which are or have been in his possession, custody or authority together with an affidavit verifying the list;

(2) The petitioner shall make and file a further affidavit in accordance with O 24 r 7 of the Rules of court 2012 within seven days from the date of this order, stating whether he has or had at any time been in possession, custody or his control, of the documents described in the sub-paragraphs below, and/or copies thereof, and if any document once existed but is now no longer in his possession, custody, or control, to state when he was separated from it and what has happened with the said documents:

(2.1) Copies of bank statements from 2016 until present date in the accounts as follows:
