JUDGMENT

Introduction

[1] The appellant appeals against the decision of the High Court in finding him guilty of the charge for trafficking in dangerous drugs under s 39B(1)(a) of the Dangerous Drugs Act 1952 (" DDA 1952") and sentencing him to death.

[2] The charge under s 39B(1)(a) of the DDA 1952 reads as follows:-

'Bahawa kamu pada tarikh 30 March 2014 jam lebih kurang 4.00 petang, bertempat di hadapan Pintu 5, Kawasan Ketibaan Aras 3, MTB KLIA Sepang di dalam daerah Sepang, dalam negeri Selangor Darul Ehsan, telah didapati mengedar dadah berbahaya iaitu Methamphetamine seberat 284.2 gram. Oleh yang demikian, kamu telah melakukan suatu kesalahan di bawah s 39B(1)(a) Akta Dadah Berbahaya 1952 yang boleh dihukum di bawah s 39B(2) Akta yang sama.'

[3] In this appeal, the appellant raised three main issues that comprise of:

(i) The learned trial Judge erred and misdirected himself when he failed to consider that there was serious doubt as to the identity of the drug exhibits and break in the chain of evidence;

(ii) The learned trial Judge erred and misdirected himself when he failed to direct his mind as to under what section he had decided to ask the appellant t
