2025 MarsdenLR 5990
HIGH COURT MALAYA KUALA LUMPUR
TETUAN KEVIN WONG & PARTNERS AND ANOR – Appellant
Versus
FUTURA ASIA LIMITED & ANOR – Respondent
[Originating Summon No: WA-24NCvC-458-01/2025]
Interpleader relief requires valid adverse claims; failure to demonstrate such led to the dismissal of the application, affirming that funds under prior court orders are not subject to the new claims.
Headnote:(A) Civil Procedure - Rules of Court 2012 - Order 17 r 1 - Interpleader relief - Plaintiffs sought interpleader relief regarding USD2.2 million held as stakeholder sum, claiming competing adverse allegations regarding ownership - Court found no genuine competing claims justifying interpleader relief and that funds were held under prior court orders, disallowing claims of ownership by Orin Energy. (Paras 1-79)
(B) Abuse of Process - The court identified interpleader action as a tactic to hinder the enforcement of a lawful judgment obtained by Futura against Orin Energy - The application dismissed for lacking merit. (Paras 75-79)
Facts of the case:
Plaintiffs filed an Interpleader Application over a Stakeholder Sum of USD2.2 million due to conflicting claims from Defendants. The funds were held under a Consent Order pertaining to unpaid cargo delivered by Futura to Orin. Multiple legal proceedings extended its status. (Paras 3-6)
Findings of Court:
The Stakeholder Sum was not Orin's asset but held on a trust basis, and the Interpleader Application was dismissed, allowing funds to be released to Futura as intended. (Paras 10, 17-19, 75-79)
Issues: Whether competing claims justified interpleader relief, and if the Stakeholder Sum is subject to a Mareva injunction against Orin. (Paras 10-11)
Ratio Decidendi: Interpleader relief requires sufficient adverse claims; failure to demonstrate competing claims led to a dismissal of the application, highlighting the funds were already under prior court orders. (Paras 10-16)
Result: Interpleader Application dismissed with costs.

Introduction
[1] This is the 1st defendant's (Futura) application dated 2 April 2025 to strike out the Plaintiffs' Interpleader Application pursuant to O 18 r 19(1)(b) and/or (d) and/or O 17 rr 1 and 3 and/or O 92 r 4 of the Rules of Court 2012 (ROC 2012).
[2] In dealing with this application for striking out, I have to go into the merits of the Interpleader Application itself (Encl 1). Parties have put up their respective affidavits, together with the oral submissions made in Court that ensued from the written submissions filed. I will explain my findings to my decision as set out herein.
[3] This Interpleader Application vide Encl 1 is by Messrs Kevin Wong & Partners (1st plaintiff/ KWP) and Orin Energy Investments Ltd (2nd plaintiff/ Orin) for interpleader relief pursuant to O 17 r 1 ROC 2012 in respect of USD2.2 million (Stakeholder Sum) deposited in the KWP's client account.
[4] The stakeholder sum of USD2.2 million was deposited with KWP pursuant to a Consent Order dated 13 November 2020 in Admiralty Suit No WA-27NCC-17-03/2021 between Orin Energy Investments Ltd v. Futura Asia Limited [2025] 1 MLRH 210. The Consent Order was entered to prevent Futura from arresting cargo that had been delivered to Orin but remained unpaid. The sum was held on KWP's undertaking as stakeholders.
[5] The Stakeholder Sum has been the subject of multiple legal proceedings and orders, primarily:
(a) A consent order dated 13 November 2020, in Suit 17 (Admiralty Action in Personam No: WA-27NCC-17-03/2021) [Orin Energy Investments Ltd v. Futura Asia Limited [2025] 1 MLRH 210] directing that these funds be held as security for claims by Futura Asia Limited (1st defendant/ Futura) [Main Consent Order];
(b) A judgment dated 20 August 2024, in Suit 17 dismissing Orin's claims and awarding Futura approximately USD2.47 million plus costs (Suit 17 Judgment);
(c) A conditional stay order dated 25 September 2024, requiring Orin to maintain the Stakeholder Sum and top up the difference to satisfy the Suit 17 Judgment (Suit 17 Conditional Stay Order); and
(d) A Mareva injunction obtained by the 2nd defendant (Atlantis) against Orin in Originating Summons No. WA-24NCC-531-09/2023 [Atlantis Commodities Trading Pte Ltd v. Orin Energy Investments Ltd [2024] 4 MLRH 236] (OS 531/Atlantis Suit), restraining Orin from dealing with assets up to USD76.5 million (Atlantis Mareva Injunction).
[6] On 20 August 2024, the Suit 17 Judgment was entered in Futura's favour for USD2,478,929.19. The Conditional Stay that was granted on 25 September 2024 has since lapsed due to Orin's non-compliance.
[7] This Interpleader Application is filed on the plaintiffs' claim for fear of being sued by the Second Defendant (Atlantis) if they release the sum to Futura, as Orin had declared it as an asset under the Atlantis-Mareva injunction obtained by Atlantis in OS 531. The Plaintiffs contend they face competing claims to the Stakeholder Sum and seek directions from this Court regarding its disposal.
