Introduction
[1] The applicants are purchasers of parcels in a residential project known as Amani Residence located at Persiaran Puteri, Taman Puchong Hartamas, Puchong. The 3rd respondent, JKI Development Sdn Bhd, is the developer of the Project ("the developer"). The purchasers had entered into a sale and purchase agreement ("SPA") with the developer for their respective parcels.
[2] The 1st respondent is the Minister of the Ministry of Housing and Local Government ("the Minister" and "Ministry" respectively), while the 2nd respondent is the Controller of Housing in the said Ministry ("the Controller")
[3] On 1 March 2023, the purchasers were granted leave to commence judicial review proceedings for the following reliefs (see encl 23):
(a) an order of certiorari to quash the decision of the Controller vide letter dated 24 February 2017 allowing the extension of time to deliver vacant possession from the statutory 36 months to 48 months from the date of the SPAs;
(b) an order of certiorari to quash the decision in letter dated 11 March 2022 by the Controller signing on behalf of the Ministry under the Temporary Measures for Reducing the Impact of Coronavir
