INDUSTRIAL COURT KUALA LUMPUR
JAGDEEP KAUR UDHAM SINGH – Appellant
Versus
HALAL DEVELOPMENT CORPORATION BHD – Respondent
Award No: 980 of 2025 [Case No: 11/4-2879/21]

Petitioner Advocates:Muhendaran Suppiah ,Respondent Advocate: Pathma Raj,R M Murali

Constructive dismissal occurs when an employer's conduct constitutes a fundamental breach of contract, breaching the implied term of mutual trust, thus entitling the employee to consider themselves dismissed.

Headnote:(A) Industrial Relations Act 1967 - Section 20(3) - Constructive dismissal - Claimant employed as General Manager, Human Capital, constructively dismissed following transfer to General Manager of Halal Event Management without prior discussion or justification - Claimed lack of qualifications and breach of mutual trust - Court found that the transfer constituted a fundamental breach of trust and confidence - Court ruled that the dismissal was without cause. (Paras 5, 24, 28, 30-34)

(B) Employment Law - Constructive Dismissal - Determining if a constructive dismissal exists requires proving a breach of contract permitting employee to terminate employment due to actions denoting employer's intention not to be bound by the contract - Court confirmed that the Claimant evidenced a breach in mutual trust due to the transfer and lack of discussion. (Paras 23-24)

Facts of the case:
Claimant employed since September 2016, with successive contracts updated annually; transferred on 8 March 2021 without notification or consent, leading to claims of constructive dismissal and breach of trust. (Paras 4-6, 24)

Findings of Court:
Transfer treated as a fundamental breach of contract, necessitated by a lack of just cause for claims of constructive dismissal acknowledged. (Paras 24, 28)

Issues: Whether the transfer constituted a constructive dismissal under Section 20 of the Industrial Relations Act 1967 and if the employer breached mutual trust and confidence. (Paras 16, 17, 24)

Ratio Decidendi: Test for constructive dismissal hinges on a contract test - the Claimant was justified in considering her employment terminated due to the breach. The actions leading to her dismissal contravened the principles of mutual trust and confidence, totaling to support for the Claimant’s claims. (Paras 18-24, 28)

Result: Claimant's claims upheld; the Company ordered to pay total compensation of RM356,554.00. (Paras 33-34)
