MAHKAMAH TINGGI MALAYA SEREMBAN
MOHAMAD HALDAR ABDUL AZIZ, J
KAAHSHIKA NAIR SHANKER & SATU LAGI – Appellant
Versus
SAMSUDIN BASIRON & YANG LAIN – Respondent
[Rayuan Sibil No: NA-12B-29-10/2025]

An appellate court will only interfere with a trial judge's assessment of damages if there is a demonstrated error of principle, or if the award is so manifestly excessive or inadequate that it constitutes an entirely erroneous estimate of the loss.

Headnote:(A) Civil Law Act 1956 - Sections 7 and 8 - Fatal accident claim - Loss of support - Assessment of quantum of damages - Appellate Court intervention - Appellate court will not lightly interfere with trial judge's findings of fact unless it is shown that there was no judicial appreciation of evidence or the assessment is based on wrong principle of law or manifest error. (Paras 20, 31, 33-36)

(B) Damages - Loss of support - Calculation - Deductions - Practice of deducting one-third of net income for personal living expenses is consistent with modern legal trends to determine dependency value. (Paras 22, 24)

(C) Bereavement - Statutory award - Claims for bereavement damages where familial relationships qualify under the statute. (Paras 27-28)

Facts of the case:
Following a fatal road accident involving two motorists, the legal heirs of the deceased initiated an action for loss of support. The trial court determined liability at 90% for the defendants and 10% contributory negligence by the deceased. The defendants appealed specifically against the quantum of damages awarded, arguing that the assessments made by the trial court were excessive.

Findings of Court:
The court held that the trial judge's calculations regarding loss of support, including the deduction of a percentage for living expenses and the years' purchase multiplier, were reasonable and based on evidence. The court emphasized that it must exercise caution in appellate review and should not interfere with the trial judge's findings of fact simply because it might have arrived at a different figure.

Issues: Whether the trial court erred in its assessment of the quantum of damages for loss of support and bereavement, and whether the appellate court is justified in interfering with the trial judge's findings on quantum.

Ratio Decidendi: An appellate court should defer to the trial judge's findings of fact as they have the advantage of hearing and observing witnesses. Interference is only warranted if the party appealing demonstrates a prima facie case of error in principle or that the award is so high or low as to be entirely erroneous. The assessment in this case was found to be grounded in evidence and sound legal principles.

Result: Appeal dismissed with costs.
