REPRESENTATION OF THE PEOPLE (AMENDMENT) ACT, 1989

S.1 Short title

This Act may be called the Representation of the People (Amendment) Act, 1989.


S.2 Amendment of section 9

       In section 9 of the Representation of the People Act, 1950 (43 of 1950) (hereinafter referred to as the principal Act), after clause (a), the following clause shall be inserted, namely:--
       "(aa) make such amendments in the Delimitation of Parliamentary and Assembly Constituencies Order, 1976 as appear to it to be necessary or expedient for consolidating with that Order any notification or order relating to delimitation of parliamentary or assembly constituencies (including reservation of seats for the Scheduled Castes or the Scheduled Tribes in such constituencies) issued under any Central Act;".


S.3 Amendment of section 14

       In section 14 of the principal Act, to clause (b), the following proviso shall be added and shall be deemed to have been so added with effect from the 28th day of March, 1989, namely:--
       'Provided that "qualifying date", in relation to the preparation or revision of every electoral roll under this Part in the year 1989, shall be the 1st day of April, 1989.'.


S.4 Amendment of section 19

In section 19 of the principal Act, in clause (a), for the words "twenty-one years", the words "eighteen years" shall be substituted and shall be deemed to Rave been so substituted with effect from the 28th day of March, 1989.


S.5 Amendment of Fourth Schedule

In the Fourth Schedule to the principal Act, under the heading "Maharashtra", the entry "3. Town Committees." shall be omitted.


S.6 Validation

All things done and all steps taken, before the commencement of this section, in relation to the preparation or revision of electoral rolls under Part III of the principal Act in the year 1989 shall, in so far as they are in conformity with the provisions of the principal Act, as amended by sections 3 and 4 of this Act, be deemed to have been done or taken under the principal Act as amended by those sections as if the principal Act as so amended was in force at the time such things were done or such steps were taken.
