ALIGARH MUSLIM UNIVERSITY ACT, 1920
(1) This Act may be called The Aligarh Muslim University Act, 1920.
(2) It shall come into force on such date1as the Central Government may, by notification in the Official Gazette, appoint.

In this Act and in all Statutes made hereunder, unless the context otherwise requires,--
(a) "Academic Council" means the Academic Council of the University;
(b) "Board of Studies" means the Board of Studies of the University;
(c) "Chancellor", "Pro-Chancellor" and "Vice-Chancellor", mean respectively, the Chancellor, Pro-Chancellor and Vice-Chancellor of the University;
(d) "Court" means the Court of the University;
(e) "Department" means a Department of Studies and includes a Centre of Studies established by the Ordinances;
(f) "Executive Council" means the Executive Council of the University;
(g) "Faculty" means a

The Chancellor, the Pro-chancellor and the Vice-Chancellor and the members of the Court, the Executive Council and the Academic Council, for the time being, shall be a body corporate by the name of the Aligarh Muslim University and shall have perpetual succession and a common seal and shall sue and be sued by that name.]

From the commencement of this Act--
(i) the Societies known as the Muhammadan Anglo-Oriental College, Aligarh, and the Muslim University Association shall be dissolved, and all property, movable and immovable, and all rights, powers and privileges of the said Societies and all property, movable and immovable, and all rights, powers and privileges of the Muslim University Foundation Committee shall be transferred to and vest in the University and shall be applied to the objects and purposes for which the University is incorporated;
(ii) all debts, liabilities and obligations of the said Societies and Committee shall be transferred to the University and shall thereafter be discharged and satisfied by it;
(iii) all references in any enactment to either of the said Societies or to the said Comm
The University shall have the following powers, namely :--
(1)to provide for instruction in such branches of learning as the University may think fit, and to make provision for research and for the advancement and dissemination of knowledge;
(2)1 [(a)] to promote Oriental and Islamic studies and give instruction in Muslim theology and religion and to impart moral and physical training;
2 [(b)to promote the study of the religions, civil station and culture of India.]
3 [(c)to promote especially the educational and cultural advancement of the Muslims of India;]
4 [(3) to hold examinations and to grant diplomas or certificates to, and confer degrees and other academic distinctions on, persons subject to such
The degrees, diplomas and other academic distinctions granted or conferred to or on persons by the University shall be recognised by1[the Central and State Governments] as are the corresponding degrees, diplomas and other academic distinctions granted by any other University incorporated under any enactment.

The University shall invest and keep invested in securities in which trust funds may be invested in accordance with the law for the time being in force relating to trusts in1[India] a sum of thirty lakhs of rupees as a permanent endowment to meet the recurring charges of the University other than charges in respect of fellowships, scholarships, prizes and rewards :
Provided that--
(1) any Government securities as defined in the Indian Securities Act, 1920, which may be held by the University shall, for the purposes of this section, be reckoned at their face value; and
(2) the aforesaid sum of thirty lakhs shall be reduced by such sums as, at the commencement of this act, the Central Government shall, by order in writing, declare to be the total capitalised value, for the purpose of this sectio
The University shall be open to all persons (including the teachers and taught) of either sex and of whatever race, religion, creed, caste or class :
Provided that nothing in this section shall be deemed to prevent religious instruction being given in the manner prescribed by the Ordinances to those who have consented to receive it.]

Every student of the University shall reside either in the Hall1[or hostel] or under such conditions as may be prescribed by the Ordinances.

All recognised teaching for the purpose of University degrees, diplomas and certificates shall be conducted 2 [under the supervision of the Academic Council and in accordance with the Statutes and Ordinances].

(1) The President shall be the1[Visitor] of the University.
(2) The1[Visitor] shall have the right to cause an inspection to be made by such person or persons as he may direct, of the University, its buildings, laboratories, and equipment, and of any institution maintained by the University, and also of the examinations, teaching and other work conducted or done by the University, and to cause an inquiry to be made in like manner in respect of any matter connected with2[the administration or finances of] the University3[***].
4[(2A) The Visitor shall, in every case, give notice to the University of his intention to cause an inspection or inquiry to be made and on receipt of such notice, the University shall have the right to make such representation to the visitor as it may consider necessary.

1[18. The Pro-Chancellor
2[(1) The Pro-Chancellor shall be elected by the Court in such manner and for such term as may be prescribed by the Statutes.
(2) The Pro-Chancellor shall, in the absence of the Chancellor preside over the convocations of the University held for conferring degrees.]

1 [19. The Vice-Chancellor
(1) The Vice-Chancellor shall be appointed by the Visitor in such manner as may be prescribed by the Statutes.
(2) The Vice-Chancellor shall be the principal executive and academic officer of the University, and shall exercise general supervision and control over the affairs of the University and give effect to the decisions of all the authorities of the University.
(3) The Vice-Chancellor may, if he is of opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report to such authority the action taken by him on such matter :

The Pro-Vice-Chancellor shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed by the Statutes.

1[20A. The Honorary Treasurer
(1) The Honorary Treasurer shall be elected by the Court in such manner and for such term as may be prescribed by the Statutes.
(2) The Honorary Treasurer shall exercise such powers and perform such functions as may be prescribed by the Statutes.]

(1) The Registrar shall be appointed in such manner as may be prescribed by the Statutes.
(2) The Registrar shall have the power to enter into agreements, sign documents and authenticate records on behalf of the University and shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.

1 [23.The Court
(1)The Court shall consist of the Chancellor, the Pro-Chancellor, the Vice-Chancellor and the Pro-Vice-Chancellor (if any) for the time being, and such other persons as may be specified in the Statutes.
(2)The Court shall be the supreme governing body of the University and shall exercise all the powers of the University not otherwise provided for by this Act, the Statutes, the Ordinances and the Regulations and it shall have power to review the acts of the Executive and the Academic Councils (save where such Councils have acted in accordance with powers conferred on them under this Act, the Statutes or the Ordinances)
(3) Subject to the provisions of this Act, the Court shall exercise the following powers and perform the following duties, namely :--

A person shall be dis-qualified for being chosen as, and for being, a member of any of the authorities of the University if he is not a citizen of India.]

1[27. Power to make Statutes
Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely :--
(a) the constitution, powers and functions of the authorities of the University2[* * *] and such other authorities as may be constituted from time to time;
(b) the election and continuance in office of the members of the said authorities, the filling of vacancies of members, and all other matters relative to those authorities for which it may be necessary or desirable to provide;

1[28. Statutes
(1) On the commencement of the Aligarh Muslim University (Amendment) Act, 1981, the Statutes in force immediately before such commencement, as amended by that Act, shall be the Statutes of the University.
(2) After the commencement of the Aligarh Muslim University (Amendment) Act, 1981, the Court may, notwithstanding anything contained in sub-section (1), make new or additional Statutes or may amend or repeal the Statutes referred to in sub-section (1) in the manner hereinafter provided in this section.
(3) The Executive Council may propose to the Court the draft of any Statute for its consideration and such draft shall be considered by the Court at its next meeting :

(1) Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely :--
(a) the admission of students to the University and their enrolment as such;
(b) the courses of study to be laid down for all degrees, diplomas and certificates of the University;
(c) the award of degrees, diplomas, certificates and other academic distinctions, the qualifications for the same and the means to be taken relating to the granting and obtaining of the same;
(d) the fees to be charged for courses of study in the University and for admission to the examinations, degrees and diplomas of the University;

(1) The authorities of the University may make Regulations consistent with this Act, the Statutes and the Ordinances --
(a) laying down the procedure to be observed at their meetings and the number of members required to form a quorum;
(b) providing for all matters which by this Act, the Statutes or the Ordinances, are to be prescribed by Regulations; and

1[34. Annual Reports
(1) The Annual Report of the University shall be prepared under the direction of the Executive Council and shall be submitted to the Court on or after such date as may be prescribed by the Statutes and the Court shall consider the Report in its annual meeting.
(2) The Court shall submit the Annual Report to the Visitor and also to the Chancellor along with its comments, if any.]

1[35. Annual accounts
(1) The annual accounts and balance-sheet of the University shall be prepared under the direction of the Executive Council and shall, once at least every year and at intervals of not more than fifteen months, be audited by the Comptroller and Auditor-General of India or by such person or persons as he may authorise in this behalf.
(2) A copy of the annual accounts, together with the audit report thereon, shall be submitted to the Court and the Visitor along with the observations of the Executive Council.
(3) Any observations made by the Visitor on the annual accounts shall be brought to the notice of the court and the observations of the Court, if any, shall after being considered by the Executive Council, be submitted to the Visitor.

(1) Every1[employee] of the University shall be appointed on a written contract, which shall be lodged with the University and a copy of which shall be furnished to the1[employee] concerned.
(2) Any dispute arising out of a contract between the University and any of its1[employees] shall at the request of the1[employee] concerned, be referred to a Tribunal of Arbitration consisting one member appointed by the Executive Council, one member nominated by the1[employee] concerned and an umpire appointed by the2[Visitor]. The decision of the Tribunal shall be final, and no suit shall lie in any Civil Court in respect of the matters decided by the Tribunal. Every such request shall be deemed to be a submission to arbitration upon the terms of this section within the meaning of the Indian Arbitration Act, 1899, and all the provisions of that Act, with the exception of Section 2 thereof,
1[36A. Procedure of appeal and arbitration in disciplinary cases against students
(1) Any student or candidate for an examination whose name has been removed from the rolls of the University by the orders or resolution of the Vice-Chancellor, Discipline Committee or Examination Committee, as the case may be, and who has been debarred from appearing at the examinations of the University for more than a year, may, within ten days of the date of receipt of such order or copy of such resolution by him, appeal to the Executive Council and the Executive Council may confirm, modify or reverse the decision of the Vice-Chancellor or the Committee, as the case may be.
(2) Any dispute arising out of any disciplinary action taken by the University against astudent shall at the request of such student, be referred to a Tribunal of Arbitration and th
Every employee or student of the University shall, notwithstanding anything contained in this Act, have a right to appeal, within such time as may be prescribed by the Statutes, to the Executive Council against the decision of any officer or authority of the University and thereupon the Executive Council may confirm, modify or reverse the decision appealed against.]
(1) The University shall constitute for the benefit of its officers, teachers and servants such1[pension or provident funds or provide such insurance scheme] as it may deem fit in such manner and subject to such conditions as may be prescribed by the Statutes.
(2) Where such provident or pension fund has been so constituted, the Central Government may declare that the provisions of the Provident Funds Act,2[1925], shall apply to such fund, as if it were a Government provident fund.

No act or proceeding of any authority of the University shall be invalidated merely by reason of the existence of a vacancy or vacancies among its members.
1[40. Protection of action taken in good faith
No suit or other legal proceeding shall lie against any officer or employee of the University for anything which is in good faith done or intended to be done in pursuance of the provisions of this Act, Statutes or Ordinances.

A copy of any receipt, application, notice, order, proceeding, resolution of any authority or committee of the University or other documents in possession of the University or any entry in any register duly maintained by the University, if certified by the Registrar, shall be received as prima facie evidence of such receipt, application, notice, order, proceeding or resolution, document or the existence of entry in the register and shall be admitted as evidence of the matters and transactions therein where the original thereof would, if produced, have been admissible in evidence, notwithstanding anything contained in the Indian Evidence Act, 1872 or in any other law for the time being in force.]
