KOLKATA IMPROVEMENT (AMENDMENT) ACT, 2002

An Act to amend the Kolkata Improvement Act, 1911. Whereas it is expedient to amend the Kolkata Improvement Act, 1911 (Ben. Act V of 1911) for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Fifty-third Year of the Republic of India, by the Legislature of West Bengal, as follows:--

S.1 Short title and commencement

• (1) This Act may be called the Kolkata Improvement (Amendment) Act, 2002.
• (2) It shall be deemed to have come into force with effect from the 31st day of January, 1994.

S.2 Substitution of new words "Municipal Corporation" for the word "Municipality" in Ben. Act V of 1911

In the Kolkata Improvement Act, 1911 (hereinafter referred to as the principal Act), for the word "Municipality", wherever it occurs, the words "Municipal Corporation" shall be substituted.

S.3 Amendment of section 82

In the principal Act, in section 82,--

• for sub-section (1), the following sub-section shall be substituted:--

  "(1) The duty imposed by the Indian Stamp Act, 1899 (2 of 1899), shall be increased,--

  • on instruments of sale and gift, respectively, by two per centum on the market value of property, irrespective of value set forth in such instruments; and
  • on instrument of a usufructuary mortgage, by two per centum on the amount secured by such instrument, where such instruments referred to in clause (a) or clause (b), affect immovable property situated in any area within the jurisdiction of the Kolkata Municipal Corporation and executed on or after the commencement of this Act.

  Explanation.-- In this sub-section, the expression "market value" shall mean such value as defined in clause (16B) of section 2 of the Indian Stamp Act, 1899."
