CALCUTTA MUNICIPAL (AMENDMENT) ACT, 1964

An Act to amend the Calcutta Municipal Act, 1951. Whereas it is expedient to amend the Calcutta Municipal Act, 1951 (West Ben. Act XXXIII of 1951), for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Fifteenth Year of the, Republic of India, by the Legislature of West Bengal, as follows:--

S.1 Short title

This Act may be called the Calcutta Municipal (Amendment) Act, 1964.

S.2 Amendment of section 7 of West Bengal Act XXXIII of 1951

In clause (a) of section 7 of the Calcutta Municipal Act, 1951 (hereinafter referred to as the said Act),--

(a) for the word "eighty-one", the words "one hundred and one" shall be substituted;
(b) in sub-clause (t), for the word "eighty", the words "one hundred" shall be substituted.

S.3 Amendment of section 8

In section 8 of the said Act, for the word "eighty", the words "one hundred" shall be substituted.

S.4 Amendment of section 70

In section 70 of the said Act, after the words "this Act", the words "or after the commencement of the Calcutta Municipal (Third Amendment) Act, 1962 (West Ben. Act XXV of 1962)" shall be inserted.

S.5 Amendment of section 172

In section 172 of the said Act,--

(a) in sub-section (2), after the words "for a period of six years", the words "irrespective of any alteration in the number or boundaries of such ward during the currency of such period" shall be
(b) After sub-section (2), the following sub-section shall be inserted, namely:--

"(2A) Notwithstanding anything to the contrary elsewhere contained in this Act, after the date of commencement of the Calcutta Municipal (Amendment) Act, 1964 (hereafter in this subsection referred to as the said date),--

(a) a general valuation in accordance with the provisions of sub-section (2) shall, in all cases, whether any general valuation under this Act has previously been made or not, be made within such period or periods, not exceeding six years from the said date, as the State Government may, by notification in the Official Gazette, specify in this behalf and different periods may be so specified in respect of diff

S.6 Substitution of new Schedule for Schedule V

For Schedule V to the said Act, the following Schedule shall be substituted, namely:--
