S.R.O.No 148/98. - In exercise of the powers conferred under sub-section (1) of section 565 of the Kerala Municipality Act, 1994 (20 of 1994) read with sub-section (1) of section 222 thereof the Government of Kerala hereby make the following rules, namely:-

S.Rule 1 Short title and commencement.

(1) These rules may be called the Kerala Municipality (Employees Medical Attendance) Rules, 1998.

(2) They shall come into force at once.

S.Rule 2 Definitions.

In these rules unless the context otherwise requires,-

(a) 'Act' means the Kerala Municipality Act, 1994 (20 of 1994);

(b) 'Employees' include the permanent employees and full-time contingent employees of the Municipality.

Note.-- If any dispute arise as to whether a particular category of employees are or a particular employee is a full-time employee or not, the matter shall be referred to the Government and the decision of the Government thereon shall be final.

(c) Words and expressions used and not defined in these rules, but defined in the act shall have the meanings respectively assigned to them in the Act.

S.Rule 3 Applicability.

These rules shall apply to all employees of the Municipality.

S.Rule 4 Application of the Kerala Government Servants Medical Attendance Rules, 1960 and concerned Government Orders.

Unless otherwise provided in these rules, the Kerala Government Servants Medical Attendance Rules, 1960 (hereinafter mentioned as the said rule) as amended from time to time, shall mutatis mutandis apply to the employees of Municipality.

S.Rule 5 Authority to sanction reimbursement of cost of medicine purchased.

(1) The Secretary shall be competent to sanction reimbursement of costs not exceeding rupees one thousand, Chairman shall be competent to sanction reimbursement of costs exceeding rupees one thousand and not exceeding rupees two thousand five hundred, Council shall be competent to sanction reimbursement of costs exceeding rupees two thousand five hundred and not exceeding rupees ten thousand and Government shall be competent to sanction reimbursement of coasts exceeding rupees ten thousand.

Provided that in all cases conditions and limitations contained in the said rules shall be observed.

(2) The Secretary shall subject to the provisions contained in the said rules, draw and disburse the amount eligible to the employees and the expenditure on this account shall be debited from the same head of account from which the salary and allowances of the employees concerned are debited.
