West Bengal Act IX of 2022

An Act to amend the West Bengal Clinical Establishments (Registration, Regulation and Transparency) Act, 2017.

WHEREAS it is expedient to amend the West Bengal Clinical Establishments (Registration, Regulation and Transparency) Act, 2017, for the purpose and in the manner hereinafter appearing; (West Ben. Act IV of 2017. )

It is hereby enacted in the Seventy-third Year of the Republic of India, by the Legislature of West Bengal, as follows:- 

1 Short title and commencement

(1) This Act may be called the West Bengal Clinical Establishments (Registration, Regulation and Transparency) (Amendment) Act, 2022.

(2) It shall come into force at once.

2 Amendment of section 5 of West Ben. Act IV of 2017

After sub-section (1) of section 5 of the West Bengal Clinical Establishments (Registration, Regulation and Transparency) Act, 2017, the following sub-section shall be inserted:—

"(la) The Chief Medical Officer of Health of a health district, as may be notified by the State Government, shall be the Registering Authority as well as the licensing authority within his jurisdiction in respect of clinical establishments situated in the respective health district.".
