Headnote:Criminal Procedure Code, 1973—Section 197—Summoning of respondent No. 2 who was Deputy Excise and Taxation Commissioner for offences under Section 420, 406 and 161 IPC on a private complaint filed by petitioner—Sessions Court set aside order—Revision—Bus of petitioner were impounded for non-payment of passengers tax—Complainant paid Rs. 1,50,000 to respondent No. 2 at his residence as asked for and was told to be issued receipt for the amount—Receipt not issued despite demands—No case of complainant that amount was paid as bribe—Respondent would be said to have acted in discharge of his official duty—Act alleged as offence was directly and reasonably connected with official duty—Requirement of sanction for prosecution was essential—Impugned order called for no interference.

       Result: Petition dismissed.
