2011 MarsdenLR 2533
COURT OF APPEAL, PUTRAJAYA
LIM HEAN CHONG – Appellant
Versus
PP – Respondent
[Criminal Appeal No: P-05-289-2010]
The standard for circumstantial evidence in a murder case requires proof beyond a reasonable doubt, and gaps in evidence can lead to reasonable doubt and acquittal.
Headnote:(A) Penal Code - Section 302 - Murder charge - Appellant accused of killing the deceased under circumstances involving circumstantial evidence and competing narratives regarding the events leading to the death - The absence of blood stains or forensic evidence linking the appellant to the crime and the existence of reasonable doubt led to the acquittal. (Paras 57, 58)
Facts of the case:
The deceased owned a business dealing with antiquities and was found dead with evidence suggesting violence was inflicted upon him. The appellant was seen at the scene, but evidence raised questions about his guilt. (Paras 3-10)
Findings of Court:
The court found that the prosecution failed to prove its case beyond reasonable doubt, emphasizing the gaps in evidence and the possibility of third-party involvement. (Paras 57, 58)
Issues: Key issues included whether the circumstantial evidence sufficiently proved the appellant's guilt and if the absence of forensic links established a reasonable doubt regarding the appellant's involvement. (Paras 24, 54)
Ratio Decidendi: The court held that where evidence is purely circumstantial, it must meet rigorous standards of certainty, which were not satisfied in this case. The appellant's flight and presence were insufficient to establish guilt. (Paras 53-56)
Result: Conviction quashed, sentence of death set aside, appellant acquitted and discharged. (Para 58)
