[1] The appellant Fisar Bin Haji Abdullah appealed against the decision of the High Court made on 19 August 2011 in favour of a claim by the respondent Malayan Banking Berhad against the appellant as a guarantor to an overdraft and term loan facilities for the sum of RM1,095,472.79 and RM4,428,831.34 respectively as at 31 October 2006.

[2] The appeal to this Court was allowed and the order of the High Court was set aside with costs in the sum of RM10,000.00. Our reasons are as follows.
