A federal judge in Albany, New York, has dismissed a challenge to the state's licensing program for selling legal marijuana. The lawsuit, filed by two California applicants, alleged that the program unconstitutionally discriminates against out-of-state residents. However, Judge Anne M. Nardacci ruled that the public interest in allowing properly licensed businesses to take over the market outweighs the concerns raised by the lawsuit. She also stated that the main purpose of the dormant Commerce Clause, which the plaintiffs argued should allow them access to New York's market, does not apply to the federally illegal cannabis trade.
