The Delhi High Court has affirmed the conviction and 20-year prison sentence of two men found guilty of gang rape, reinforcing the judicial mandate to protect survivors of sexual violence. In a significant judgment passed by Hon’ble Mr. Justice Manoj Kumar Ohri, the court not only upheld the lower court’s verdict but also ordered an increase in the compensation awarded to the survivor to the maximum limit prescribed under the Delhi Victim Compensation Scheme, 2018.
The incident, which took place in October 2015, involved the brutal sexual assault of a young woman near a wooded area in Keshav Puram. The appellants, Mohd. Abid and Mohd. Hasmudeen, were arrested on the same day after the prosecutrix identified them. While the initial FIR mentioned offenses under the POCSO Act, subsequent medical evaluations confirmed the prosecutrix was an adult, leading the trial court to frame charges under Section 376D (gang rape) and Section 506 (criminal intimidation) of the Indian Penal Code (IPC).
Both men pleaded not guilty, claiming they were falsely implicated during a consensual encounter. However, the prosecution presented a robust case through the testimony of the survivor, an independent eyewitness, and conclusive forensic evidence.
The defense counsel argued that the survivor’s testimony contained "material improvements" compared to her initial statements and pointed to perceived lapses in the investigation. They claimed the incident was a consensual physical relationship and that the accused were targeted due to family disapproval.
Conversely, the State, supported by the Amicus Curiae, argued that the testimony was consistent on all material aspects. They highlighted that the survivor’s account of being raped by one accused while the other stood guard was corroborated by an independent witness (PW-2) who, while unable to name the accused, explicitly recalled seeing a sexual assault in progress and hearing the victim’s screams.
The High Court meticulously addressed the defense's claims, noting that the forensic evidence solidified the survivor’s account. The Court stated:
> "The MLC records 'hymen ruptured' and there was no delay in reporting the incident. The appellants came to be arrested on the very same day and the FSL report also lends support to the case of prosecution."
Regarding the reliability of the survivor's testimony, Justice Ohri observed:
> "In light of the testimony of the prosecutrix, the independent witness, and the medical and forensic reports on record, this Court has no hesitation in concluding that the appellant/Abid committed the offence of rape."
The Court also weighed the involvement of the co-accused, noting that:
> "It has come in the testimony of the independent witness that there were two persons; and the appellant/Hasmudeen was arrested on the day of the incident upon identification by the prosecutrix and he was also identified in Court, and as such his complicity in the crime also stands established."
The High Court dismissed the appeals, confirming the 20-year rigorous imprisonment and the fines imposed by the Sessions Court. Critically, the Court exercised its discretion to enhance the financial support provided to the victim, directing the Member Secretary of the Delhi State Legal Services Authority (DSLSA) to ensure the maximum compensation under the 2018 scheme is disbursed within two weeks.
This judgment serves as a stern reminder of the judiciary's commitment to prioritizing the testimony of survivors and ensuring that compensation is not merely a formality, but a rehabilitative necessity, adhering to the highest standards of the Delhi Victim Compensation Scheme.
