Gauhati High Court Seeks Senior Counsel's Assistance in Recruitment Dispute

Guwahati: The Gauhati High Court, in a batch of writ petitions concerning recruitment processes for Class-III and Class-IV government posts, has requested the assistance of the Additional Advocate General, Assam, to navigate the complex issues involved. The order was passed by the bench of Justice Soumitra Saikia on April 28, 2025.

The primary case, WP(C) No. 2290 of 2024 (Gitartha Das vs. The State of Assam and 7 Ors) , is linked with several other petitions filed by various individuals challenging aspects of government recruitment. The respondents in these cases include key state government bodies such as the Chief Secretary, Personnel Department, Social Justice and Empowerment Department, Health and Family Welfare Department, State Level Recruitment Commissions for Class-III and Class-IV posts, and the Medical Board represented by the Principal-cum-Chief Superintendent of Gauhati Medical College and Hospital.

During the hearing, Mr. SK Roy , learned counsel representing the petitioners, informed the court about the filing of an additional affidavit in one of the linked cases, WP(C) No. 2337/2024. The court directed that copies of this affidavit be served to the respective learned counsel for the respondents, granting them time to file replies if necessary.

Highlighting the intricate nature of the matters at hand, the Court specifically requested Mr. B. Gogoi , the learned Additional Advocate General, Assam, to provide his assistance. A copy of the order has been directed to be served upon Mr. Gogoi .

The details of the specific grievances raised by the petitioners are not elaborated in this procedural order, but the array of respondents and the involvement of the Medical Board and Social Justice & Empowerment Department suggest issues potentially related to eligibility, medical fitness, or reservations in the recruitment process.

The batch of petitions has been listed for further hearing on May 15, 2025 , where the court is expected to delve deeper into the substantive issues with the assistance of the Additional Advocate General.
