GLC Thiruvananthapuram Alumnus Mohammed Hussain Empanelled as Joint Secretary (Legal & Treaties) in Ministry of External Affairs
New Delhi – In a significant development for India's diplomatic and legal corps, Mohammed Hussain K.S., an accomplished international law expert and alumnus of Government Law College, Thiruvananthapuram, has been empanelled for the prestigious position of Joint Secretary (Legal & Treaties) in the Ministry of External Affairs (MEA). The appointment underscores a career marked by deep engagement with the codification and progressive development of international law, both in intergovernmental organisations and in direct service to the nation.
Mr. Hussain, who currently serves as the Legal Advisor at the Permanent Mission of India to the United Nations in Geneva, brings a wealth of experience from the front lines of international legal negotiations and arbitrations. His new role will place him at the heart of India's legal policymaking on the global stage, overseeing the intricate processes of treaty negotiations, interpretations, and their domestic implementation.
A Distinguished Academic and Professional Trajectory
Mr. Hussain's journey to this senior MEA position is built on a formidable academic foundation. He earned his Bachelor of Law from the esteemed Government Law College, Thiruvananthapuram, a cradle for many legal luminaries. He further honed his expertise with a Master of Laws from the School of Legal Studies at Cochin University and an M.Phil. in International Law from the renowned School of International Studies at Jawaharlal Nehru University (JNU), New Delhi.
His professional career began at the Indian Society of International Law, where he served as a Research Officer, immersing himself in the scholarly aspects of the field. This foundational experience paved the way for a significant tenure as Senior Legal Officer at the Asian–African Legal Consultative Organisation (AALCO). At AALCO, an intergovernmental body representing 47 member states, Mr. Hussain was actively involved in its core mission: "working towards the progressive development and codification of international law." This role provided him with a unique multilateral perspective and deep insights into the legal traditions and priorities of nations across Asia and Africa.
An accomplished scholar in his own right, Mr. Hussain has contributed extensively to legal literature. His portfolio includes several research articles on critical and evolving areas of international law, such as environmental law and sustainable development, the legal framework of the World Trade Organization (WTO), and international human rights law.
A Decade of Defining India's Legal Stance at the MEA
Since joining the Ministry of External Affairs in 2011, Mr. Hussain has become an indispensable part of India's international law apparatus. His career within the ministry is a case study in the multifaceted role of a government international lawyer, blending diplomacy, negotiation, litigation, and legislative drafting.
He has been a key member of the Indian delegation in numerous high-stakes bilateral and multilateral negotiations. Notably, he played a significant role in the complex and protracted negotiations for the BBNJ (Biodiversity Beyond National Jurisdiction) Agreement. Also known as the 'High Seas Treaty', this landmark instrument, adopted in 2023, aims to conserve and sustainably use marine biological diversity in areas beyond national jurisdiction, a testament to the collaborative and painstaking work of legal experts like Mr. Hussain.
His expertise in the law of the sea was further demonstrated through his contributions to crucial maritime boundary issues. He was a vital member of India's legal team in the maritime boundary arbitration with Bangladesh before the Permanent Court of Arbitration. The tribunal's 2014 award peacefully resolved a long-standing dispute, and the meticulous legal work of the Indian team was central to securing a favorable outcome that has since fostered greater regional cooperation. Furthermore, Mr. Hussain was involved in the technical and legal work concerning the submission of claims for the outer limits of India's continental shelf, a complex process under the UN Convention on the Law of the Sea (UNCLOS) that has significant implications for a nation's sovereign rights over seabed resources.
Bridging International Commitments and Domestic Law
A critical aspect of Mr. Hussain's work has been translating India's international obligations and interests into domestic law. His involvement in drafting key domestic legislation with international law implications highlights the seamless integration required between a nation's foreign policy and its internal legal framework.
His most notable contribution in this area is his active role in the drafting of the Maritime Anti-Piracy Act of 2022 . This legislation was crucial for providing a comprehensive domestic legal framework to combat piracy on the high seas. It empowered Indian authorities to apprehend and prosecute pirates, aligning Indian law with its obligations under UNCLOS and enhancing maritime security in the Indian Ocean Region. This work exemplifies the practical, real-world impact of a government legal advisor, ensuring that international principles are effectively operationalized within the national justice system.
Mr. Hussain's empanelment as Joint Secretary (L&T) is a recognition of his profound expertise and dedicated service. In his new capacity, he will lead a critical division responsible for advising the government on all matters of international law, shaping India's legal voice in global forums, and safeguarding the nation's interests within the framework of a rules-based international order. His career serves as an inspiring blueprint for law students and practitioners aspiring to a career in public international law and diplomacy.
