In a significant ruling for educators across the state, the High Court of Gujarat has struck down the state government's attempt to restrict salary arrears for primary teachers. Justice Nirzar S. Desai criticized the state’s stance on treating pay-scale revisions as "notional," declaring that teachers are entitled to full financial arrears regardless of the existence of promotional posts.
The dispute originated from primary teachers in Botad District who were appointed between 2010 and 2011. Under a 1994 Government Resolution, these teachers became eligible for a higher pay scale (Rs. 5,000–8,000) upon completing nine years of service. However, for years, the state failed to implement this entitlement, only issuing a remedial Government Resolution (GR) on October 12, 2022.
While the 2022 resolution finally acknowledged the teachers' entitlement, it contained a critical catch: it treated the period between the date of eligibility and the date of the resolution as "notional," effectively denying the teachers the back-pay they had earned.
The State government attempted to justify the denial of arrears by arguing that certain Municipal School Boards lacked promotional posts, such as "Education Inspector," which it claimed served as a technical barrier to releasing arrears.
In a robust legal critique, the High Court dismissed this argument as fundamentally "fallacious." The Court observed that the 2022 resolution was explicitly designed to rectify pay anomalies where seniors earned less than their juniors simply because they worked in different school boards with varying promotional structures.
The judgment clarifies that policy-driven benefits cannot be applied in a discriminatory manner:
Relying on previous rulings from the High Court that had already reached finality, Justice Desai ruled that the petitioners were entitled to the arrears from the date of their eligibility. The Court ordered the respondents to calculate and disburse the arrears within 12 weeks.
While the Court denied interest on these arrears due to the policy-making nature of the dispute, the ruling serves as a vital safeguard for government employees. It sends a clear message that once the State acknowledges an entitlement to resolve a systemic anomaly, it cannot cherry-pick which employees receive back-pay based on arbitrary administrative hurdles.
For the legal community and the teaching fraternity, this judgment clarifies that equity in salary structures is an enforceable right, not a conditional privilege subject to the whims of bureaucratic interpretation.
