Gujarat High Court Quashes Detention Order Against Alleged Bootlegger, Cites Lack of Nexus to Public Order

In a significant ruling, the Gujarat High Court has quashed the preventive detention order passed against Dilipbhai Somabhai Macchi , who was detained as a 'bootlegger' under the Gujarat Prevention of Anti-social Activities Act, 1985.

Macchi challenged the legality and validity of the detention order, arguing that the grounds of detention had no nexus to the 'public order' and were merely a matter of law and order. The state, on the other hand, contended that Macchi was a habitual offender, and his activities had affected the society at large, justifying the detention order.

Court's Analysis and Reasoning

The High Court, after carefully considering the facts and submissions, held that the two prohibition cases registered against Macchi did not have any bearing on the maintenance of public order. The court relied on the Supreme Court's decision in Piyush Kantilal Mehta v. Commissioner of Police, Ahmedabad , which established the distinction between 'law and order' and 'public order'.

The court observed that the alleged anti-social activities of Macchi did not create any feeling of insecurity or panic among the public, and therefore, the subjective satisfaction of the detaining authority was not legally valid.

Decision

The Gujarat High Court quashed the detention order, directing the authorities to set Macchi at liberty forthwith, unless he is required in any other case. The court held that the material on record was not sufficient to establish that Macchi 's activities had affected or were likely to affect the maintenance of public order, as required under the law.
