In a significant exercise of its constitutional powers, the High Court of Karnataka has granted relief to a 15-year-old survivor of sexual assault, allowing her to terminate a seven-month pregnancy resulting from the crime. The order, passed by Justice C.M. Poonacha, balances the urgent physical and emotional needs of the minor with the requirements of ongoing criminal justice.
The petitioner, a minor whose identity remains protected to prevent re-victimization, approached the Court under Articles 226 and 227 of the Constitution of India. Having suffered the trauma of sexual assault, she sought the court’s intervention to terminate her pregnancy, which had reached seven months' gestation. Beyond the medical procedure, the petitioner also requested the legal machinery to preserve the fetus for DNA analysis—a critical step in the ongoing criminal investigation in Crime No. 15/2026 at the RMC Yard Police Station.
Recognizing the sensitive nature of the case, the High Court had previously directed the Superintendent of K.C. General Hospital, Bengaluru, to constitute a specialized medical board. The board’s findings were clear: "As pregnancy as resulted due to sexual assault, we the board members opine for termination of pregnancy at this stage after explaining and counseling the patient and relatives about the complications associated with termination of teenage pregnancy."

The Court’s ruling is comprehensive. Beyond the medical procedure, it has mandated that the state meet the full financial burden of the petitioner's medical expenses and counseling. Furthermore, the Court paved the way for the petitioner to receive victim compensation under the "Compensation Scheme for Women Victims/Survivors of Sexual Assault/other," directing the District Legal Services Authority to consider the disbursement of Rs. 3,00,000.
This order reaffirms the judiciary's proactive role in protecting the reproductive and constitutional rights of minors in vulnerable situations. By facilitating both the medical termination and the evidentiary preservation required for the criminal case, the Court has demonstrated that the legal system can be aligned to support victims while ensuring the integrity of evidence.
