In a move prioritizing the welfare of lower-cadre government employees, the High Court of Himachal Pradesh has ordered the State government to expedite the release of pending financial arrears to a retired Class-IV staff member. The ruling, delivered by Hon'ble Mr. Justice Ajay Mohan Goel, marks a significant stance against the practice of piecemeal payment disbursements to long-serving employees at the end of their careers.
The petitioner, Chet Ram, approached the court seeking several reliefs, most notably the re-fixation of his pay scale and the release of substantial financial arrears. While the petition initially included a prayer for counting daily wage services from 1990 for seniority purposes, the petitioner chose to strategically narrow his focus to the re-fixation of pay in accordance with his regularization date.
The core of the dispute lay in the discrepancy between the calculations provided in the State’s response and the actual emoluments received by the petitioner, who is now approximately 60 years old.
During the proceedings, Counsel for the petitioner argued that despite the calculations acknowledged by the State, the petitioner had received only a fraction of his dues. He emphasized that at his age, the petitioner required the full release of his retirement-related earnings.
The State, represented by the Additional Advocate General, did not contest the calculation of the dues but failed to expedite the actual payment.
Justice Ajay Mohan Goel, in his examination, observed that for a Class-IV employee, the total amount owing—though not "humongous" by state standards—is of vital importance to the individual's livelihood. The Court reasoned that releasing these funds in small tranches would offer the petitioner little utility, whereas a total settlement would allow him to utilize the funds for his personal needs during his twilight years.
The judgment reflects a compassionate approach toward the administrative processes of the State:
The Court disposed of the petition with a clear, time-bound directive. The State has been ordered to: 1. Release all pending payments identified in the State’s own preliminary submissions within three months. 2. Disburse any additional arrears arising from revised pay scales within the same timeframe.
To ensure compliance, the Court included a penalty clause: should the State fail to meet this three-month deadline, the outstanding amount will accrue simple interest at a rate of 6% per annum, calculated from the date of the judgment until the actual realization of funds.
This decision serves as a subtle reminder to administrative departments that bureaucratic delays in releasing emoluments to retiring low-level staff are not merely an administrative oversight, but a matter that warrants judicial intervention to ensure dignity at the end of service.
