Curbing the Menace: Kerala HC Orders Uniform National Highway Enforcement Against Overloaded Trucks

In a significant move to enhance road safety and protect national infrastructure, the Kerala High Court has intervened in a long-standing grievance regarding the rampant overloading of heavy vehicles on National Highways. Through a detailed order, the Division Bench comprising Justice Raja Vijayaraghavan V. and Justice K. V. Jayakumar has mandated the immediate implementation of a unified Standard Operating Procedure (SOP) to ensure strict compliance with the Motor Vehicles Act , 1988.

The Backdrop: A Fight Against Overloading

The petitioner, P.B. Satheesh, representing the Nerkazhcha Association, approached the court highlighting that despite existing notifications regarding maximum load-carrying limits for trucks, trailers, and tractors, enforcement remained inconsistent and inadequate. The court’s intervention was prompted by the urgent need to address the structural and safety risks posed by overloaded consignments, which frequently bypass weight restrictions.

The Proposed Legal Framework

Following directions from the bench, the National Highways Authority of India (NHAI) and state authorities collaborated to frame an SOP aimed at eliminating ambiguity in enforcement. The mechanism introduces a systematic workflow: * Screening : Vehicles undergo automated screening via Weigh-in-Motion (WIM) systems, with registration numbers captured by ANPR cameras. * Confirmation : Flagged vehicles are intercepted and directed to a Static Weigh Bridge (SWB) for legally valid axle and Gross Vehicle Weight (GVW) certification. * Enforcement : Non-compliant vehicles face severe penalties under Section 194 of the Motor Vehicles Act , including mandatory off-loading and potential license suspension or revocation for repeat offenders.

Key Observations from the Bench

The court emphasized that the new protocols are designed to foster consistency across all jurisdictions, ensuring that those responsible for overloading face immediate consequences.

> "The procedure is intended to eliminate ambiguity, secure consistency in implementation, and ensure that violations are dealt with firmly and uniformly across jurisdictions," noted the court.

Further underscoring the necessity of this mandate, the judges stated:

> "The SOP has been framed with the specific object of ensuring strict and effective enforcement action against vehicle owners, operators, and drivers in accordance with the provisions of the Motor Vehicles Act , 1988 and the Central Motor Vehicles Rules , 1989."

Regarding the government's responsibility to act decisively, the bench added:

> "The Government shall take all necessary administrative and supervisory measures to ensure that the SOP... is implemented strictly and in its true letter and spirit."

Implications for Future Compliance

The court’s order represents a major shift from reactive policing to a standardized, data-driven enforcement model. By requiring the NHAI and various state agencies—including the police and mining departments—to coordinate their efforts, the court aims to ensure that no vehicle exceeds the safe axle load limits prescribed by Central government notifications.

The authorities have been directed to publicize the SOP widely and file a compliance report within 30 days. This directive serves as a stern reminder that the safety of National Highways is a non-negotiable priority, and that the rule of law must be applied "uncompromisingly" regarding vehicle load limits. The case will next be reviewed in one month to examine the progress of the implementation phase.
