Right to Fair Investigation under Article 21

In a poignant order highlighting the state's solemn duty toward justice, the Madras High Court has intervened in the tragic death of a five-year-old student, emphasizing that a fair investigation is not merely a procedural requirement but a fundamental right under Article 21 of the Constitution . Justice B. Pugalendhi, presiding over the case, expressed grave concerns regarding the initial handling of the investigation into the child's death at a private school in Tirunelveli.
The petitioner, the father of the deceased UKG student, approached the court with deep-seated apprehensions regarding the circumstances of his daughter’s death on March 24, 2026. While school authorities initially projected the event as a tragic vehicular accident occurring at 3:55 p.m., the grieving father identified significant inconsistencies. Most notable was the unopened lunch box in the child’s bag, casting doubt on the timeline of events and suggesting the tragedy might have occurred much earlier in the day.
Compounding his grief were allegations of systemic opacity: the school management allegedly failed to inform the parents promptly, dodged phone calls, and reportedly pressured the family into accepting compensation in exchange for silence.
The petitioner argued that the local police response was insufficient. He pointed to the presence of 20 officers at the scene even before he arrived—yet, according to his account, they appeared more interested in protecting the school’s interests than in securing critical evidence, such as the vehicle involved or immediate access to CCTV footage.
The respondent police maintained that they had acted swiftly once the complaint was formalized, identifying the accused and recovering footage. However, the Court remained unconvinced by the delayed registration of the FIR and the perceived lenient treatment of those responsible for the breach of school security.
The Court did not mince words regarding the transformation of education into a commercial venture at the cost of student safety:
Finding the local investigation wanting in both transparency and urgency, the Court directed the Superintendent of Police, Tenkasi , to withdraw the case from the current station and transfer it to a senior officer—either a Deputy Superintendent of Police or an Inspector of Police—known for a sincere track record.
Furthermore, the Court ordered that the new Investigating Officer must furnish the petitioner with copies of the recovered CCTV footage and regular updates on the investigation’s progress. By mandating these steps, the High Court has underscored a vital principle: the state's obligation to the victim’s family is the cornerstone of constitutional protection, particularly when a child’s life is lost under suspicious circumstances. The matter is currently under review, with the Court leaving the door open for further intervention should the investigation fail to meet the required standards of impartiality.
