In a move reinforcing the judiciary's preference for amicable resolutions in minor criminal matters, the Delhi High Court has quashed an FIR registered against a motorist involved in a 2022 traffic accident. Hon’ble Mr. Justice Manoj Jain, presiding over the matter, exercised the court's inherent powers to close the chapter on a dispute that had already been resolved through a high-value settlement.
The case dates back to November 17, 2022, when the petitioner, Manoj Kumar, was involved in a road traffic incident while returning home from Airport Palam. According to the state, the petitioner was driving his motorcycle in a rash and negligent manner, resulting in a collision with a pedestrian (Respondent No. 2), who sustained simple injuries.
Following the incident, FIR No. 0594/2022 was registered at Police Station Dwarka South under Sections 279 (rash driving) and 337 (causing hurt by negligence) of the Indian Penal Code, along with charges under the Motor Vehicles Act. While the case had progressed to the stage of prosecution evidence, both parties eventually chose to put the incident behind them.
In a classic example of out-of-court resolution, the parties formalized a Compromise Deed on March 14, 2026. The terms were comprehensive: the petitioner agreed to pay Rs 5,50,000 to the respondent as full and final settlement of all claims, including the withdrawal of a pending Motor Accident Claims Tribunal (MACT) petition. During the virtual hearing, the respondent confirmed that he accepted the compensation voluntarily, without coercion, and expressed no objection to the quashing of the criminal proceedings.
The court's decision was anchored in the principle that judicial time and public resources should not be squandered on prosecution when a victim is satisfied and an agreement has been reached. Justice Manoj Jain noted that continuing the criminal trial would yield no tangible benefit to the justice system.
Applying its inherent powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 , the Court determined that the quashing of the FIR was essential to "secure the ends of justice."
The judgment underscores the court’s commitment to facilitating peaceful resolutions over prolonged litigation:
The FIR, along with all consequential legal proceedings, stands quashed. However, the court did not grant the relief without a caveat: the petitioner has been ordered to deposit costs of Rs 10,000 with the Dwarka Court Bar Association within four weeks. The original compromise documents are to be submitted to the Trial Court within two weeks to finalize the closure of the case.
By prioritizing this settlement, the Delhi High Court has once again signaled that in non-heinous offenses, the law serves as a gateway to compensation and closure rather than merely a vehicle for punitive action.
