The High Court of Gujarat has granted significant procedural relief to acclaimed filmmaker Rajkumar Santoshi, allowing him to travel abroad for promotional activities related to his upcoming film, Lahore 1947 , and extending the deadline for specific financial deposits.
The petitioner, Rajkumar Santoshi, had previously been granted a suspension of his sentence regarding criminal revision applications pending before the High Court. As a condition of this suspension, the Court had mandated a financial undertaking involving the deposit of substantial sums of money. Furthermore, as is customary in such bail conditions, the Court had restricted the applicant from leaving India without prior judicial authorization.
With the promotional cycle for his new venture, Lahore 1947 , requiring his presence overseas, and faced with the complexities of fulfilling financial deposit schedules, the filmmaker approached the High Court seeking a modification of these specific conditions.
The proceedings primarily centered on two requests: 1. Financial Extension: The applicant requested an additional eight weeks to deposit the remaining Rs. 35 lakhs of an outstanding Rs. 41.50 lakh obligation. 2. Travel Permission: The applicant sought a temporary suspension of the condition barring international travel, supported by flight documentation confirming a departure on December 30, 2025, and a return on January 5, 2026.
Counsel for the complainant expressed opposition, arguing that the applicant had not fully adhered to his previous undertakings, thus casting doubt on the necessity of further leniency.
Justice P. M. Raval, presiding over the matter, underscored the need for balancing the complainant's interests with the practicalities of the ongoing litigation. In a significant balancing act, the Court noted:
> "Having heard, the learned advocates for the respective parties and considering the averments made in the applications and the fact that the substantial amount has been paid by the applicant... the interest of justice would be served if time is extended up to 31.01.2026."
Addressing the request for travel, the Court remarked:
> "When substantial amount of the entire cheques under question have been deposited, it would be in the interest of justice that the aforesaid condition is suspended for timebeing and the applicant be allowed to leave India."
The High Court adopted a firm but accommodative stance: * Deposit Deadline: The Court granted a one-time extension for the financial deposit, setting the final deadline for January 31, 2026. Crucially, the Court issued a strict warning: "It is made clear that no further extension shall be granted under any circumstances." * Travel Authorization: The condition prohibiting international travel was temporarily suspended between December 30, 2025, and January 5, 2026, allowing Mr. Santoshi to fulfill his professional obligations.
This ruling reflects the judiciary's role in maintaining the integrity of recovery-based bail conditions while acknowledging the professional exigencies of the petitioner, provided that substantial compliance has been demonstrated. By setting a "hard" deadline for the final payment, the Court has signaled that while it is open to flexibility, the sanctity of judicial undertakings remains paramount.
