High Court of Kerala Accepts Unconditional Apology in Suo Motu Criminal Contempt Case Proceedings

The High Court of Kerala has officially closed criminal contempt proceedings initiated against the directors of the media entity "Karma News," marking a significant resolution regarding the responsibilities of digital media platforms. The proceedings, led by a bench comprising Justice Raja Vijayaraghavan V and Justice K. V. Jayakumar, centered on the dissemination of scurrilous content that undermined the integrity of the judicial system.

The Origin of the Contempt

The matter arose following a news report aired on May 5, 2024, by the web-based channel "Karma News." The broadcast featured an interview with P.C. Jose, the General Secretary of the Human Rights Association of International (HRAI). During the segment, Mr. Jose made extreme, defamatory statements, including claims of establishing a "constitutional court" and purporting to sentence a sitting Judge to imprisonment. Furthermore, the interviewee leveled baseless allegations of corruption against the judiciary, referring to courts as "bootlickers of the British."

The Court initiated suo motu proceedings, asserting that such content was not merely false but calculated to lower the authority of the judiciary and erode public confidence in the rule of law.

Arguments and Judicial Accountability

The legal discourse focused on the extent of editorial responsibility for content published by media houses. While P.C. Jose was excused due to his history of medical treatment for mental health, the Court turned its focus to the management of "Galaxy Zoom India Private Limited," the company operating Karma News.

Initially, the 2nd respondent (the CEO) was discharged as he was not in charge of the company’s day-to-day operations at the time of the broadcast. The Court subsequently impleaded the Managing Director and another Director (Respondents 3 and 4) after identifying them through the Ministry of Corporate Affairs records. These respondents argued that they were Australian residents who were not physically present to oversee the daily functions of the news channel and that they had authorized the CEO to manage operations.

Despite this, the directors acknowledged their ultimate liability as the owners and offered an unconditional, heartfelt apology to the bench, promising greater vigilance in future editorial decisions.

Key Observations from the Bench

The High Court issued stern observations regarding the intersection of press freedom and judicial integrity:

• "The freedom of the press, while sacrosanct, carries with it an equally weighty responsibility."
• "Media platforms cannot become conduits for vilifying the judiciary or undermining public confidence in the administration of justice."
• "Such reckless dissemination of derogatory and unverified assertions strikes at the very foundation of the rule of law and cannot be countenanced."
• "Irrespective of the status and competence of the 1st respondent, the News Channel broadcasting his views should have exercised editorial discretion."

The Resolution

Recognizing that the apology tendered by the directors was bona fide and accompanied by assurances that preventive measures were now in place, the Court invoked Rule 14(a) of the Contempt of Courts (High Court of Kerala) Rules, 1988.

The Court accepted the unconditional apology, discharged the respondents, and officially closed the contempt case. This ruling serves as a reminder to digital media entities that editorial autonomy is not absolute and that the dissemination of content attacking judicial officers carries severe legal risks under the Contempt of Courts Act , 1971.
