Furthermore, documentation issues—specifically the presence of the name 'Sushadevi' (the stepmother) rather than 'Sreeja' (the mother) in the petitioner’s school certificate—served as additional barriers to certification.

The petitioner contended that her father had long deserted the family and lived abroad with a separate household, thus rendering his income irrelevant to their economic status. Documentary evidence, including certificates from the local Grama Panchayat, corroborated the desertion, while expert reports on land usage proved that the majority of the land held was agricultural, not residential.

Judicial Interpretation of EWS Criteria

Justice N. Nagaresan found the denial of the EWS certificate unsustainable. The Court clarified that when a parent has abandoned a family, their income should not be calculated toward the eligibility criteria.
