The denial was predicated on two grounds: the petitioner’s mother supposedly exceeding the landholding limit of 4.13 cents and a discrepancy regarding the mother’s name in secondary school records. The petitioner, having been abandoned by her father 12 years ago, argued that the family unit solely comprised her and her mother, who possesses no independent income.

The Administrative Dispute

The state authorities had initially rejected the application, asserting that the family’s landholdings surpassed the permissible limit of 4.13 cents, with the mother listed as holding 6.95 cents. Furthermore, documentation issues—specifically the presence of the name 'Sushadevi' (the stepmother) rather than 'Sreeja' (the mother) in the petitioner’s school certificate—served as additional barriers to certification.

The petitioner contended that her father had long deserted the family and lived abroad with a separate household, thus rendering his income irrelevant to their economic status. Documentary evidence, including certificates from the local Grama Panchayat, corroborated the desertion, while expert reports on land usage proved that the majority of the land held was agricultural, not residential.

Judicial Interpretation of EWS Criteria

Justice N. Nagaresan found the denial of the EWS certificate unsustainable. The Court clarified that when a parent has abandoned a family, their income should not be calculated toward the eligibility criteria. Regarding land usage, the Court noted that the Government of Kerala’s own orders require a nuanced interpretation: once the built-up and setback areas are calculated, the remaining land must be categorized as agricultural, exempting it from the residential land limit for EWS purposes.
