The High Court of Kerala at Ernakulam has delivered a definitive ruling on the governance limits of University authorities, upholding the suspension of the University of Kerala’s Registrar. Justice T.R. Ravi, presiding over the case, underscored that university syndicate meetings must adhere strictly to statutory procedures, dismissing attempts by members to bypass the Vice-Chancellor’s authority.
The conflict originated following an event hosted by the Sree Padmanabha Seva Samithi at the University’s Senate Hall on June 25, 2025. The Registrar, K.S. Anilkumar, canceled the permission for the event mid-program due to reported security concerns involving student unions and the display of religious emblems—an action taken while the Governor of Kerala was in attendance. Following this incident, the Vice-Chancellor suspended the Registrar, citing a severe lapse in administrative responsibility.
A subsequent attempt by a section of the Syndicate to revoke the suspension order at a specially convened meeting became the core of the legal debate. The petitioners argued that the Syndicate had the authority to override the Vice-Chancellor. However, the University management maintained that the meeting in question was improperly convened after the Vice-Chancellor had formally dissolved the proceedings due to disorderly conduct.
The High Court rejected the validity of the meeting held by the dissenting Syndicate members. Justice Ravi relied on precedents to establish that the power to convene and conduct meetings is inherently tied to the authority of the Vice-Chancellor under the University Act.
The Court noted: > "No meeting of the Syndicate can happen at the instance of the individual members and has to be necessarily with the junction of the Vice-Chancellor and the Registrar."
The judgment further warned against the chaos that could ensue from an unchecked interpretation of statutory rules: > "Even if the Vice Chancellor was in his office, a meeting can be held in another room by 5 members of the Syndicate and call it as a Syndicate meeting, which is not what is contemplated by law."
Regarding the broader responsibility of academic institutions, the Court remarked: > "The University is supposed to be the guardian of the Higher Education System and its functioning cannot be derailed by political or other considerations and should be guided only by academic considerations."
The Court dismissed the challenge against the suspension, ruling that the decision-making process led by the dissenting members was not in accordance with law. However, in an effort to resolve the administrative gridlock, the Court directed the Vice-Chancellor to convene a fresh, formal meeting of the Syndicate through the Registrar-in-Charge.
This ruling reinforces the administrative hierarchy within Kerala’s university system, clarifying that while the Syndicate holds significant power, it must act within the framework of prescribed, legitimate procedures. The outcome mandates that the University must return to formal governance to address the disciplinary status of the Registrar, ensuring that future decisions are legally binding and clear of procedural irregularities.
