In a scathing judgment that underscores the sanctity of judicial proceedings, the High Court of Delhi has dismissed a petition seeking the quashing of an FIR involving charges of bigamy and dowry (Section 498A/406/34/494 IPC). The Court, presided over by Justice Girish Kathpalia, uncovered a web of deceit involving fraudulent marriage registrations and a divorce decree obtained through blatant misrepresentation.
The case originated from a matrimonial dispute between petitioner no.1 (the husband) and respondent no.2 (the complainant). While the parties sought to quash the FIR citing a compromise, the Court’s intervention revealed deeper systemic rot. Investigations showed that the husband was already married to a woman named Deepa, with whom he had two children, a fact he concealed while marrying respondent no.2 in 2020.
Not content with the initial fraud, the parties later obtained a divorce decree under the Hindu Marriage Act by falsely declaring the husband’s status as a "bachelor." The Court discovered that the lawyers representing both sides actively participated in suppressing these facts, with the petitioner’s counsel and the lawyers behind the divorce petition sharing professional addresses and documentation.
The judgment serves as a stern warning against the manipulation of judicial mechanisms:
Expressing deep concern over the subversion of the law, Justice Kathpalia dismissed the quashing petition and imposed exemplary costs of Rs 1,00,000 upon the petitioners, payable to Bharat Ke Veer .
The Court issued stringent directions to ensure accountability: 1. Criminal Probe: Police at PS Harsh Vihar must take appropriate legal action, with a report filed before the Registry within three days. 2. Judicial Inquiry: A copy of the judgment has been sent to the Family Court-01, District Shahdara, for appropriate action regarding the illicit divorce decree. 3. Institutional Accountability: The Marriage Registration Office is now tasked with investigating the fraudulent certificate issued to the parties. 4. Professional Conduct: The Bar Council of Delhi has been formally notified to initiate proceedings against the lawyers involved in the deceitful professional conduct.
This ruling underscores the judiciary’s intolerance for parties who attempt to use the legal system as a shield for their own fraudulent activities, signaling a strict stance for future matrimonial disputes.
